My niece is 16 and pregnant and her dad said he will kick her out if she doesn’t give the baby up for adoption. She desperately wants to keep the baby. Can he kick her out since she is a minor or can she live at home w the baby legally?

Hello, thank you for reaching out to NRS. We are not legal experts by any means, but from what we know if parent kicks their child out and does not provide a safe alternative living arrangement then it can be considered neglect. So legally, your niece's dad cannot just kick her out of the house without another place to stay. If he does do this you or your niece can report it to child services. You can get more information about this and help making a report if needed by contacting the national child abuse hotline at 1-800-422-4453 or childhelphotline.org.

Her dad can give her permission to live with another friend or family member if your niece was comfortable with it. From what you mentioned, the household could be a stressful environment for her if she chooses to keep the baby and stay with her dad. Another option could be a transitional living program(TLP). TLPs are long term housing programs for young people that provide the support they need to eventually live independently. If you would like to know more about this as an option, you can call our hotline at 1-800-786-2929.

We hope this was the information you were looking for. If you or your niece would like to talk more in-depth about the situation and further explore options, do not hesitate to call or chat with us anytime.

      Take care,
      NRS
