  • Underage Marriage in OK

Okay, so my boyfriend and I are both 17. We want to get married for two reasons. 1) I'm going to get custody of my little brother and sister, and we need to be married to do that.. 2) I want to get out of my dads house.

What I need you to answer is, if I'm married, then am I automatically emancipated? Or do I still have to live with my dad?

My boyfriend lives in OK as well, just in a different part. I want to move in with him. He has a stable job, a truck, and a house, so the only thing we are missing is me being there. So, if we get married, can I move out?

For the record, both of our mothers will sign for us to be married.

    Re: Underage Marriage in OK

    Hello there,

It sounds like you and your boyfriend are pretty set on getting married at age 17 in Oklahoma. We aren’t legal experts, but often that information can be obtained through your local county clerk’s website. For example, in Oklahoma County it says “Minors 16 or 17 years of age may obtain a marriage license when one of the legal custodial guardians or parents is present with valid photo identification, with a certified copy of each minor’s birth certificate issued by a state or county, not by a hospital.” More information can be found here: http://www.oklahomacounty.org/courtc...rvicesFAQ.aspx.

In most cities/states, being legally married as a minor is one way of getting emancipated. That said, it sounds like you would also like to try getting guardianship of your younger siblings which may require going to court with their legal guardian as well. You are welcome to reach out to us directly to continue going over your situation and hopefully coming up with options. Hopefully this gives you enough general information to further your search. Good luck!
