  • Custody to aunt

    I'm 15. My dad threatens to beat me and used to when I was young. I don't want to live with him. I want to live with my aunt. He told me that if I don't want to live with him, I can go but not to keep in contact with him(but I feel like he is not gonna let me go). If my aunt, dad and me all agree for her to have my custody, can the judge still say no? How long will it take? Do we have to go to court? Do we need any other reason?

    Thanks so much for reaching out and sharing a little bit about what’s been going on, we know that it takes a lot of courage. It must be really hard to live in a home with so much tension. You deserve to feel safe at home and it's very worrisome to hear that your dad was previously physically abusive. Absolutely no one deserves to be hurt like that.

    We aren't legal experts, but generally speaking, if both your dad and aunt are agreeable to her taking custody it should be a decently smooth process but will most likely involve legal proceedings. Sometimes custody transfers will need to go through the family court system and it may be beneficial to speak with a legal advocate.
