Hello and thank you for contacting the National Runaway Safeline. We are sorry to hear that your mom is overbearing and that the way she is acting is making you feel like you are in a very small box. You are an adult and you deserve to be treated like one. We are not legal experts so we cannot really speak to the legality of whether or not your friend’s phone can be considered stolen. A resource that could be helpful is your local police non-emergency number. If you explain the situation, they might be able to give you a more precise answer to your theft-related questions. Another resource that might be helpful for gaining your independence is the national Job Corps, reachable at jobcorps.gov or 1-800-733-5627. They are a social service that provides vocational training and education, drivers’ ed, and sometimes even room and board for those who are utilizing its program. If you have any questions or concerns that you feel haven’t been addressed, please don’t hesitate to reach out to us again on our 24/7 hotline 1-800-RUNAWAY or on chat at 1800runaway.org.

Is it considered theft since it's not my phone?

If I'm 18 and I borrowed a phone from a friend and got caught with it at outpatient, 1. are they legally able to give it to her although I'm 18 and 2. isn't it considered theft because in her words she says its her phone but in reality it isn't even my phone. It's a friends phone, and it wasn't given to me at home.
Plus I get her reasoning behind taking my phones but she also SMASHED the iPod 4 I paid for. But on other devices I did send some explicit photos/videos and received some. And I threaten to call the cops on her but she comes back at me saying "My House My Rules." And shes one of those parents who HAS to know what you're doing. She even has my Facebook password, and she keeps my school computer at night. If I say I'm going to hang out with a friend she HAS to know who it is and if she doesn't know who it is she says 'no' like I'm ********ing 18 I don't have my ********ing license either because of her dumb ass rules and I would move out but I can't support my self.
