  • Daughter refuses to go home to Wisconsin - abused by stepfather

My stepdaughter is 17 and is visiting her father and I in Florida. Her father has joint legal custody and used to have equal physical custody 50/50. We are in Florida now, she lives with her mother full time in Wisconsin. She is visiting and informed us she is severely depressed, and being abused by her stepfather. She is supposed to go back on the plane to that house next Friday. She has been suicidal in the past and hospitalized for cutting and depression. Do we have to send her back there, or can we file for custody and keep her here while we straighten things out?
